At 16:29 AEDT today the Supercars National Court of Appeal received a Notice of Appeal on behalf of Triple Eight Race Engineering. 

 

The Appeal confirms the intention of the team to appeal the severity of the 15 second post-race time penalty handed down to Car #88 (Jamie Whincup/Paul Dumbrell) for Careless Driving after causing contact with Car #33 (Scott McLaughlin/David Wall) at Turn 21 on Lap 150 of the 2016 Supercheap Auto Bathurst 1000. 

 

Under the Supercars Operations Manual - Judicial Rules, the Appeal must contain all matters which the appellant intends to raise before the Court.

 

The receipt of the Notice of Appeal follows the interim decision of the Court this morning rejecting an application made by Triple Eight to expand the grounds of their appeal.

 

The reasons for this morning’s interim finding by the Court have now been published and are available for download by clicking here.

 

Contrary to media reports, the result of the Bathurst 1000 is still subject to the Court's final determination. The Court has the power to impose its own penalty which may or may not include time penalties. 

 

The hearing will take place at the County Court of Victoria in Melbourne at 7pm AEDT on Tuesday 18 October, 2016.

Supercars National Court of Appeal hands down interim decision
 
 

The Supercars National Court of Appeal has handed down an interim decision in relation to the Notice of Intention to Appeal lodged by Triple Eight Race Engineering on 9 October 2016 at the 2016 Supercheap Auto Bathurst 1000.

 

Earlier this week the Court received an application from the team seeking amendment of the Notice of Intention to Appeal. When the Notice was filed on Sunday the team had stated their grounds for appeal related only to the severity of the penalty handed down by the stewards.

 

The interim application requested that the ground for appeal be extended to include:

a. That there was an error in the application and interpretation of the rules by the stewards; and
b. That natural justice was denied by the stewards.

 

At 1230 AEDT today the court denied the application from the team. The reasons for the denied application will be released at a later stage.

 

Triple Eight have been granted an extension to file their original Notice of Appeal to 1755 AEDT today. 

 

As per the Supercars Operations Manual, CAMS has appointed a Supercars National Court of Appeal that will include three members drawn from a Judicial Panel of independent persons.

 

The Judicial Panel will comprise of Walter Sofronoff QC (Chairman), Barry Pilgrim (Deputy Chairman) and Christopher Blanden QC.

 

Sofronoff QC, serving as Chairman of the Court, is the former Solicitor-General of Queensland and is now currently a Member of the University of Queensland Law School’s Advisory Board and a Fellow of The Institute of Arbitrators & Mediators Australia.

 

Deputy Chairman Pilgrim is a retired lawyer and has run a successful private practice in Sydney. Pilgrim also has past motor sport experience as a competitor at club level.

 

Experienced mediator Blanden QC has served as a member of the Supercars National Court of Appeal since 2007, and was a Chairman on the Panels of Inquiry for CAMS in 2007.

JAMIE'S TOP THREE SYDNEY 500 MEMORIES

He’s lifted the championship trophy there four times and is just days away from take five, but what are JDub’s top three most memorable Homebush moments?

Oh, and for anyone wondering, his 2008 trophy was won and presented at Oran Park.

  1. The top one would be Saturday’s race last year when it was do or die for the championship and we put in one of our best performances for my first Sydney 500 race win.
  2. Second was when I was into the X Factor one year and whoever the winner was performed at the front of the grid, which I got to see. That was pretty cool.
  3. Number three was “he’s in the fence. They’re both in the fence. THEY’RE ALL IN THE FENCE!”. That obviously wasn’t a good moment, but one of the biggest memories for me of Homebush.

PHILLIP ISLAND 400 SATURDAY WRAP

 
Ford Performance Racing’s Mark Winterbottom has made a welcome return to the podium at Phillip Island, finishing third in the second race where team-mate Chaz Mostert closed to just four points off his much-prized fifth place in the standings.

Winterbottom surged to the lead in the second race but did not quite have the pace to hold top spot, eventually settling for third.

The opening race was a tougher affair with an off-track excursion and resultant pit stop consigning him to 24th.

Mostert endured a similarly hard first race after being punted off track by Garth Tander, though his fight back and a strong top 10 run in the day’s final outing sees him close the points gap.

David Reynolds enjoyed his most consistent outing for quite a few events though he believes he can further improve for Sunday’s feature race.

Jack Perkins felt his improved qualifying effort marked progress but was incensed with a number of overly-audacious moves in the final race which saw drop to the back of the pack.

“It has been a tough year and our team deserves credit for how well we started the year. We were going well there for most of the year but we dug ourselves a bit of a hole mid-year which cost us. We are on the up though and are getting there but we weren’t good enough for the whole year so full credit to Jamie (Whincup) and his team. In the first race I was just trying to have a crack and I just didn’t have as much grip as the people I was racing. I took all the grass from turn one to two when I went off which forced me to stop as the engine was about to go kaput. The podium was nice but winning is what we are here to do so we’ll keep pushing to improve.”
 
Chaz Mostert - #6 Pepsi Max FPR Ford:

“I didn’t qualify too poorly, though I did make a mistake in the second session. The two 10-minute sessions limit what you can change if you need to make changes and we did so that cost us a little. I was holding fourth until (Garth) Tander went up the inside of me and he didn’t give me a lot of room. The contact reefed the steering wheel out of my hands and that dropped me down the field. We didn’t have many opportunities to pass in the second race and that was it. We did make some gains today and I think we can improve out pace for tomorrow.”

“Today we’ve gone for a bit of a different set-up today, which is something we wouldn’t really do except here at Phillip Island. It’s been good to tick the box, and see how it goes, but it’s also been frustrating because we haven’t had as much pace as we’ve been used to. It’s a bit of a one-step back, two-steps forward situation, I think. Qualifying was consistent, and had a good first race. I don’t have massive pace, but I’m able to battle and hold position. I got pushed off in the last race, and then had to hold position from there to finish 12th.”
 
Jack Perkins - #18 JELD-WEN FPR Ford:

“We were consistent in qualifying, with 17th in both races. It’s not where we want to be, but it’s better than being in the 20s. That shows a sign of improvement, which is good. We’ll look to improve that tomorrow to have a good run in the longer race. The first race was lacklustre, starting and finishing 17th. We made some great changes for the second race, and I got a great start making up a few spots, and had a bit of pace. Then I got used up by someone I respect, in car #8, and dropped right back to last. I had a lot of pace on the guys around me, but got pushed off again by someone who got over ambitious so it was just a case of hanging on after that. We’ll turn it around and have another crack tomorrow.”

“Obviously it was a disappointing day with the championship now out of our grasp but our improved qualifying pace and a return to the podium for Frosty was a positive. The longer race tomorrow will suit us better so we all expect to have a stronger day. Congratulations to Jamie Whincup and Triple Eight on their title success.”

FIVE THINGS YOU DIDN'T KNOW ABOUT THE GOLD COAST 600

Okay, we're using the phrase “didn't know” loosely; we have no doubt that there are some Indy loyals out there who can tick off all five of these as general knowledge. So think of it more as “Five Things You Might Not Have Known About The Gold Coast 600 But If You Do Then You're Awesome”.

  1. This year brings up the 20th anniversary of V8 Supercars on the Gold Coast.
  2. From 1994 to 2002 it was a non-championship event, with 17 races in total run without counting for series points.
  3. The IndyCar Series raced on the streets of Surfers Paradise from 1991 to 2008 as the main attraction.
  4. The 600km format debuted in 2010 and international co-drivers were mandatory for the first three years.
  5. Race one this weekend will be Triple Eight's 350th V8 Supercars Championship start.

WELCOME TO THE ENDURO SEASON. SANDOWN, HERE WE COME!

The 2014 Sandown 500 marks a pretty special anniversary for Craig Lowndes. Believe it or not, it’s exactly 20 years since ‘The Kid’ first raced a V8 Supercar, so we delved deep into his memory bank to find out his top three most unforgettable enduro moments – the good, the bad and the ugly.
  • Bathurst 1996 – his maiden Bathurst win in his first full-time season in a V8 Supercar. It was the perfect end to a perfect season and conquering the holy grail of Australian motorsport is an indescribable feeling.
  • Bathurst 2006 – when even the gods could not have planned a more fitting finish. With the death of Peter Brock just a fortnight before hanging heavy over the mountain that year, Lowndesy’s win was a fairytale ending to one of the most memorable Bathurst 1000s.
  • Bathurst 2005 – the flying tyre. Triple Eight was delayed in conquering the mountain when our ’05 effort was rudely interrupted by a rogue tyre that came sailing out of nowhere to collide with the windscreen of the No.888 car, sending it into the pits and ending any hopes of an eduro double.
